Good morning,

I am currently investigating the release of confidential information related to Magdalena ASBJOURNHUS and her children, per a complaint by the BC Ministry of Children and Family Development. The Ministry contacted the RCMP to investigate the release of information protected under several BC Statutes and Acts. Specifically Section 75 of the Child Family and Community Service Act and Sec. 3(6) of the Provincial Court Act. Sec. 3(6) PCA states "In relation to family or children's matters before the Court, a person must not publish at any time anything that would reasonably be likely to disclose to a member of the public the identity of the child or party". Child protection proceedings have been designated by the Attorney General as "family or children's matters before the court: and it is accordingly a breach of this section to publish the name of children or parents involved in child protection proceedings. The publication of child specific protection information on your website constitutes an offence under both acts noted.

I am conscious of the fact that your organization may not have been aware of the Act and were not acting to contravene the same. I am therefore respectfully requesting that you remove the noted information, including names from your website. The Constitution and the associated freedoms are strongly enshrined in our legal system and well protected. However, in the case of children and child protection, the Courts have recognized the importance of ensuring the privacy and confidentiality of those children and their families.
